The Fair Labor Standards Act

The Fair Labor Standards Act (FLSA) was designed to ensure employees get paid for all hours worked. According to the U.S. Department of Labor, employers are required to pay employees at least the federal minimum wage and overtime pay for all hours worked over a 40-hour work week. FLSA also states that hours worked includes the entire amount of time an employee is expected to be on duty and/or on the employer’s premises. Therefore, whether you are at your desk, training, waiting, or traveling for work, you should be paid.

  • Meal Periods – employers will ask workers to continue a project through lunch and off-the-clock—to be considered an acceptable meal period, workers must be allowed to take a 30-minute, uninterrupted lunch away from their work station
